PIERRE, S.D. (AP) - A Faulk County jury acquitted a man of the most serious charges against him for the death of a fellow Dell Rapids resident who fell from a moving pickup. Glen Kroll was driving Aug. 10 near Cresbard when Otey Rogers The Third was killed.
Authorities say Rogers was riding in the box when he climbed onto the roof, then the hood, and fell off when the truck came to a curve and Kroll hit the brakes.
A jury late last week found Kroll guilty of third-offense drunken driving and driving under revocation. But he was acquitted of vehicular homicide and an alternate count of second-degree manslaughter.
Kroll was sentenced to two years in prison, lost his driver's license for five years, has to pay $1,500 in fines and repay trial and lawyer costs.
